A bill that would allow gay Marylanders to visit a partner in the hospital and make medical decisions for him or her is one step closer to becoming law.
State senators voted 30-17 this week to pass the bill. It must next navigate the House of Delegates, where it has sat untouched since it was reviewed March 4 in committee.
In a statement, gay Sen. Rich Madaleno (D-Montgomery County) praised the Senate vote as “a small step” forward for unmarried Marylanders.
“This important bill guarantees all unmarried couples access to partners in medical facilities and the right to make medical decisions,” he said.
For the final vote, one Republican supported the bill and four Democrats opposed it.
Sen. Alan Kittleman (R-Carroll and Howard counties) voted for the measure, while Sens. Ed DeGrange (D-Anne Arundel County), Roy Dyson (D-Calvert, Charles and St. Mary’s counties), Anthony Muse (D-Prince George’s County) and Norman Stone (D-Baltimore County) voted against it.
Carrie Evans of Equality Maryland said unlike earlier versions that proposed a statewide database of domestic partnerships, the bill would have health care facilities verify partnerships independently through documents such as joint leases or affidavits.
She noted the bill is written so that no proof is required during emergency situations.
“So when you’re meeting the ambulance at the hospital,” Evans said, “you’re not having to worry about having these papers.”
