LGBT rights supporters on Capitol Hill are looking to an Illinois congressman for inclusion in his upcoming immigration reform bill that’s expected to appeal to more liberal members of the U.S. House.

Rep. Luis Gutierrez (D-Ill.) last week issued a statement of core principles for his planned comprehensive reform legislation, which includes a belief in family “as a cornerstone of our immigration system.”

“Family is the bedrock of our society, and immigration reform must support strong, united families and treat all immigrant families fairly and equally,” says the statement. “Right now, our broken immigration system keeps too many American families apart for years and even decades, when they have done everything legally.”

The statement calls for immigration rules “predicated on family values” that keep family members together.

Rachel Tiven, executive director of Immigration Equality, said her organization is hoping Gutierrez’s commitment means he would include an LGBT provision in his bill.

Specifically, Tiven is looking for a provision allowing gay Americans to sponsor their foreign partners for residency in the United States. Such a measure would be similar to the Uniting American Families Act, a standalone bill pending in Congress.

“We are really, really encouraged by Congressman Gutierrez’s principles that came out [last] week that emphasize that all families need protection and that comprehensive immigration reform is a package that will provide security and safety for all families,” she said.

Rep. Jerrold Nadler (D-N.Y.), who introduced a standalone version of UAFA in the House, has been talking to Gutierrez about the importance of LGBT inclusion in immigration reform, according to his office.

Ilan Kayatsky, a Nadler spokesperson, said he has been speaking with Gutierrez as well as other lawmakers involved in crafting immigration reform legislation.

“It is clear that no comprehensive immigration reform would truly be comprehensive if LGBT families are excluded,” Kayatsky said. “We will continue to do everything possible to pass UAFA and bring justice to bi-national same-sex couples.”

Tiven said Immigration Equality also is encouraging Gutierrez to ensure his bill includes LGBT families.

“I can tell you for certain that he has heard from constituents in his own district who have been clear that this affects their families and that they care about this a great deal,” she said.

Gutierrez’s office didn’t respond to the Blade’s request for comment on the proposed legislation.

Also expected to produce immigration reform legislation in the House is Rep. Zoe Lofgren (D-Calif.), chair of a House Judiciary subcommittee that oversees immigration rules. Sen. Chuck Schumer (D-N.Y.) has said he’s working on similar legislation in the Senate. Activists also are seeking inclusion for bi-national same-sex couples in these bills.

Tiven said she doesn’t know when Gutierrez’s bill would become public, nor does she know which of the three pieces of comprehensive reform legislation would debut first.

President Obama, who has spoken favorably about the changes that UAFA would enact, has said his administration would pursue immigration reform this year but no action on legislation is expected before 2010, according to a report in the New York Times.

The question is whether when Rep. Gutierrez says he wants to treat "all immigrant families to be treated fairly and equally" is whether he considers our families part of all families. He has a great history of being a friend of the LGBT community, but this test is going to tell us a lot about his principles of equality. To lose the love of my life because gay citizens cannot sponsor their partner to live in the US like straight couples can, is devastating. Please, Rep. Gutierrez, help our families achieve equality in immigration.

Please ask your Senators and Representatives to sponsor UAFA and RFA and bring one of these laws to vote.  We need to change this purely discriminatory immigration law and allow US citizens to sponsor their same-sex foreign born Partners.  The current immigration laws tears so many families apart either by keeping loving Partners apart or forcing a US citizen to leave their Country, thus leaving family, friends, jobs and homes.  It is unbelievable that this situation exists in the United States in 2009.

The best way for Gutierrez to reach the goal of equality in our immigration laws is to include lesbian and gay Americans in his bill! We are sick and tired of members of Congress signing on and then doing nothing - these 'I'm an original co-sponsor of UAFA so I support the issue, but don't want to include you in a larger bill' arguments are ridiculous. Everyone reading this needs to call Congressman Gutierrez and tell him that no immigration bill is truly comprehensive unless it includes lesbian and gay Americans and their families!

It is really important that gay families be included in comprehensive immigration reform -- i.e. UAFA be part of CIR. I'm one of those 36,000 gay US citizens who will have to choose between the one that I love and my country some day soon, because his visa is running out. 19 other Western democracies allow for same sex immigration (without same sex marriage). The US does not. This must be changed.

My partner of 4.5 years lives in Europe, and I am in the U.S. with no way to sponsor her immigration to come here to live with me. Please urge your Senators and Representative to support the Uniting American Families Act and its inclusion in comprehensive immigration reform so that my partner and I, along with tens of thousands of other couples, can finally be reunited. Every day that we wait is one more day too many!
